1. Who We Are and What We Provide

Prata Health, LLC is a concierge nursing and health advocacy organization serving the Phoenix and Scottsdale, Arizona area. Every client’s care is led by a registered nurse. Through the Site we share information about our Services and offer ways to contact us and request a consultation.

The Site is an informational and marketing resource. Clinical care is delivered only after a separate consultation and a written service agreement, and only within the scope of services we agree to provide to you.

2. No Medical Advice and No Emergency Services

The content on the Site is provided for general informational purposes only and is not a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of your physician or another qualified healthcare provider with any questions you may have about a medical condition, and never disregard professional medical advice or delay seeking it because of something you read on the Site.

The Site does not provide emergency medical services. If you believe you are experiencing a medical emergency, call 911 or go to the nearest emergency room immediately. Do not use the Site or its contact forms to request urgent or emergency care.

3. No Provider Relationship Created by the Site

Using the Site, submitting a form, or communicating with us through the Site does not create a nurse-client, provider-patient, or other professional relationship. A care relationship with Prata Health begins only when we and the client (or the client’s authorized representative) enter into a written service agreement and care has been arranged.

4. Eligibility

The Site is intended for users who are at least 18 years of age. By using the Site, you represent that you are 18 or older and are able to enter into a binding agreement, or that you are acting on behalf of a client as an authorized representative.

5. Consultations, Scheduling, and Communications

Requests submitted through the Site, including consultation requests and contact-form messages, are inquiries only and do not guarantee availability, acceptance, or the provision of Services. We will follow up to discuss your needs and determine whether our Services are a fit.

By providing your phone number or email address, you consent to be contacted by Prata Health regarding your inquiry and our Services. You may opt out of non-essential communications at any time. Please do not send sensitive health information through unsecured channels.

6. Service Agreements, Fees, and Payment

The scope of care, fees, billing, and payment terms for any Services are established in a separate written service agreement provided to each client. Nothing on the Site constitutes an offer of Services at any particular price, and no pricing is published on the Site. In the event of any conflict between the Site and your signed service agreement, the service agreement controls.

7. Client Responsibilities

You agree to provide accurate, current, and complete information when you contact us or when you receive Services, and to keep that information up to date. Safe and appropriate care depends on the accuracy of the information you share, including medical history, medications, and care needs. You are responsible for maintaining the confidentiality of any account or login credentials associated with the Site.

8. Privacy and Protected Health Information

Your use of the Site and our Services is also governed by our Privacy Policy and HIPAA Notice, which explains how we collect, use, disclose, and protect your personal and health information. By using the Site, you acknowledge that you have reviewed the Privacy Policy.

9. Intellectual Property

The Site and its contents, including text, graphics, logos, images, and layout, are owned by or licensed to Prata Health, LLC and are protected by intellectual-property laws. You may view and use the Site for your personal, non-commercial purposes. You may not copy, reproduce, distribute, modify, or create derivative works from the Site without our prior written permission.

Nothing in these Terms limits any liability that cannot be limited under applicable law. This section addresses use of the Site and does not alter the terms of any separate written service agreement for clinical care.

14. Indemnification

You agree to indemnify and hold harmless Prata Health, LLC and its owners, employees, and contractors from any claims, damages, liabilities, and expenses, including reasonable attorneys’ fees, arising out of your misuse of the Site or your violation of these Terms or applicable law.

15. Governing Law

These Terms are governed by the laws of the State of Arizona, without regard to its conflict-of-laws principles. You agree that any dispute arising out of or relating to these Terms or the Site will be resolved in the state or federal courts located in Maricopa County, Arizona, and you consent to the personal jurisdiction of those courts.

16. Changes to These Terms

We may update these Terms from time to time. Any changes will be posted on this page with an updated effective date. Your continued use of the Site after changes are posted constitutes your acceptance of the revised Terms.

17. Severability

If any provision of these Terms is found to be unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
